The Competition Commission, in its meeting on 16.09.2024, reviewed the Guideline “On the Referral of Cases Related to Concentrations”.
The main purpose of the Guideline is to clarify the procedures and criteria for referring cases related to concentrations between the Albanian Competition Authority and the European Commission, ensuring that cases are examined by the most appropriate authority to simplify the process and avoid duplication. Furthermore, it aims to ensure consistency in decision-making and provide greater legal certainty for undertakings involved in merger or acquisition of control by outlining clear guidelines and procedures for case referral.
For these reasons, the Competition Commission, by decision no. 1108, dated 16.09.2024, decided to approve the Guideline “On the Referral of Cases Related to Concentrations”.
Additionally, the Competition Commission reviewed the proposed concentration case through the creation of a full-function joint venture by Marcegaglia Steel S.P.A. and Manni Group S.P.A.
The proposed transaction will not create overlaps or vertical relationships between the activities of the parties at the national level, and for these reasons, the intended transaction will not bring changes or have an impact on the Albanian market.
For these reasons, the Competition Commission, by decision no. 1109, dated 16.09.2024, decided to authorize the proposed concentration obtained through the creation of a full-function joint venture by Marcegaglia Steel S.P.A. and Manni Group S.P.A.
