The Competition Commission, in its meeting on 29.12.2023, considered the notification of the concentration obtained through the acquisition of joint control of the company FIER Thermoelectric SHA by the companies DEPA Commercial S.A., GEK TERNA S.A. and GENER 2 LLC.
This concentration will not create overlaps or upstream or downstream relations between the activities of the parties at the national level and for these reasons, the intended transaction will not bring change and will not have an impact on the Albanian market
For these reasons, the Competition Commission by Decision no. 1044, dated 29.12.2023, decided to authorize the concentration realized through the acquisition of joint control of the company FIER Thermoelectric SHA by the companies DEPA Commercial S.A., GEK TERNA S.A. and GENER 2 LLC.
Also, the Competition Commission approved by Decision no. 1043, dated 29.12.2023 “The Manual of Procedures for Anti-Competitive Behaviors”.
The purpose of this Manual is to provide practical instructions for the staff of the Competition Authority regarding the conduct of investigative procedures pursuant to articles 4 and 9 of Law no. 9121/2003 “On the protection of competition”. The document aims to increase the transparency and predictability of the process within the existing legal and procedural framework, thereby improving the effectiveness of antitrust investigations.
