By decision no. 525, dated 14.06.2018 “On the closure of the preliminary investigation in the Air Transportation market of passengers towards Austrian and giving some recommendations”, the Competition Authority recommended to Austrian Airlines as a undertaking with dominant position in the relevant market, which has a special obligation to market to its passengers not to put them in unfavorable competition conditions, pursuant to the Air Code.
Pursuant to the above decision, the Competition Authority has decided to monitor the behavior of Austrian Airlines operating in the air transport market for a period of one year, to report to the Competition Authority every four months.
It also recommended to the Civil Aviation Authority to implement the Air Code within 90 days: to carry out the price analysis applied by the air carriers with a dominant position in the market; to develop a methodology for calculating undertaking costs to compare abusively high prices and discriminatory practices; to require from all air carriers to provide all the necessary and clear passenger information, which must be exhibited in a distinct way to passengers; to require from the airport managing body to ensure that the general information on passengers rights is clearly and visibly displayed within the airport in order to ensure that passengers at the airport to be informed of the cancellation of their flight and their rights.
