The Competition Commission, in its meeting on 24.03.2023, considered the issue “On the legal assessment of Agreement Act no. 2729 prot., dated 13.02.2023, between the General Directorate of Road Transport Services, the “National Association of Driving Schools”, the Association of Driving Schools “Road Safety” and the General Directorate of Taxes, which has as its object facto and de jure the determination of the payment fee and the minimum fiscal reference cost for preparation and equipment with a driving license, according to the category of driving license, evidence or certificate.
At the end of the legal assessment, it was found that the Agreement Act No. 2729 prot., dated 13.02.2023, concluded between interest groups representing driving schools, DPSHTRR and DPT, is a prohibited agreement in itself in terms of object, in the sense of article 4, point 1, letter a), of law no. 9121/2003, as upon entry into force it will lead to the same practices in the prices/payment fees for the preparation and acquisition of the category of driving license, certificate or certificate, hindering, limiting and distorting competition in the market. As such, this Agreement Act, in the sense of Article 4, Point 2, of Law no. 9121/2003, is prohibited.
As above, the Competition Commission, with decision no. 970, dated 24.03.2023 decided:
1.Act Agreement no. 2729 prot., dated 13.02.2023, concluded between the parties: the General Directorate of Road Transport Services, the “National Driving School Association”, the “Road Safety” Driving School Association and the General Directorate of Taxes, is considered an agreement act contrary to Article 4 of Law 9121.2003, “On the Protection of Competition”.
2.Monitoring the market of the preparation service and equipment with a driving license, according to the category of driving license, evidence or certificate, for a period of 1 (one) year.
3.The non-implementation of this decision constitutes a serious violation of competition in the sense of article 74, point 1, letter c), of law no. 9121/2003.
