The Competition Commission, in its meeting on 21.06.2024, considered the opening of the preliminary investigation procedure in the public procurement market against the undertakings Adastra SHPK and Colombo SHPK.
From the evaluation of the information presented by APP, on the alleged violations of competition by the undertakings Adastra SHPK and Colombo SHPK, arise reasonable doubts that the undertakings Adastra SHPK and Colombo SHPK use the covered offer scheme by agreeing in advance which of them will submit the highest bid and which is the winning bid in the procurement procedure in which they are participating, with the aim of qualifying the entity that has the lowest bid, creating the impression of a clean bid and an effective competition.
For the above, since there are reasonable doubts that between the undertakings participating in the procurement procedures with the object “Expenses for material for the operation of office equipment”, developed by the Personnel Recruitment Center, there are elements of an anti-competitive behavior, which may constitute a restriction, distortion or obstacle to competition pursuant article 4, point 1, of law no. 9121, dated 28.07.2003, “On competition protection”:
Competition Commission by Decision no. 1089, dated 21.06.2024, decided to open the preliminary investigation procedure in the public procurement market against the undertakings Adastra SHPK and Colombo SHPK. The preliminary investigation will include the time period from 01.01.2022 to 21.06.2024.
